RETURNS, WITHDRAWAL AND CLAIMS

1. Statutory right of withdrawal

A consumer may withdraw from the contract without giving any reason within 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the product.

To exercise this right, send an unambiguous statement to tomek@wyachts.com before the 14-day period expires. A reason is optional and prior approval is not required. We will confirm receipt and provide the correct return address.

The product must be sent back no later than 14 days after the withdrawal notice. The consumer bears the direct return cost for a change-of-mind withdrawal unless mandatory law provides otherwise. The product may be inspected only as necessary to establish its nature, characteristics and functioning. The consumer may be responsible for diminished value caused by handling beyond that necessary inspection.

We refund all payments received for the returned product, including the cost of the least expensive standard delivery offered for the order, no later than 14 days after receiving the withdrawal notice. We may withhold reimbursement until we receive the product or evidence that it was sent back, whichever occurs first. Reimbursement uses the original payment method unless expressly agreed otherwise.

2. Made-to-order products

A standard W Yachts product produced after an order is placed is not automatically excluded from the right of withdrawal. An exclusion applies only to goods made to the consumer's individual specifications or clearly personalised, where permitted by law and disclosed before purchase.

3. Defective, damaged or incorrect products

If a product is damaged, faulty, misprinted, incorrect or does not conform to the contract, contact us promptly with the order number and, where possible, photographs of the item and packaging. The preferred 30-day notification period used for operational handling does not shorten statutory rights.

For a justified claim, the seller bears the required return cost and provides the remedy required by law, which may include repair, replacement, price reduction or refund.

4. Legal guarantee of conformity

Consumers benefit from the French legal guarantee of conformity for two years from delivery. A lack of conformity appearing during this period is presumed to have existed at delivery, subject to statutory exceptions. The consumer may request repair or replacement free of charge and without significant inconvenience, unless the chosen remedy is impossible or imposes disproportionate costs. Where repair or replacement is impossible, refused, excessively delayed or causes major inconvenience, the consumer may be entitled to a price reduction or termination of the contract.

This legal guarantee applies independently of any commercial warranty. It does not cover normal wear, misuse or damage caused after delivery by the customer.

5. Hidden defects

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. A claim must be brought within two years of discovering the defect. Depending on the legal conditions, the consumer may return the product for a refund or retain it and obtain a price reduction.

6. Exchanges and cancellations

Automatic size exchanges are not offered for made-to-order products. An eligible product may be returned under this policy and a new order placed. An order can usually be cancelled until production begins. Once production has started, operational cancellation may no longer be possible, without affecting statutory withdrawal and conformity rights.
